By ordering any of our products or services, you agree to be bound by these terms &
conditions. All personal information you provide us with or that we obtain will be handled
by Banyan Photography as responsible for the personal information.
Events outside Banyan Photography control shall be considered force majeure. The
price applicable is that set at the date on which you place your order. Shipping costs
and payment fees are recognized before confirming the purchase. Card information is
transmitted over secure SSL encryption. Banyan Photography reserves the right to
amend any information without prior notice.
Photograph Copyright information
All copyright (expressed or implied) is retained by Banyan Photography.
Clients are not purchasing photos and do not ‘own’ the photos but are paying for
“Photography Services and usage rights”.
Realtor and Leasing clients: Agents, Brokers, Real Estate companies, property
owners etc.
Are entering into a “Limited Usage Agreement” with Banyan Photography. The limited
usage rights include printing, displaying and transmitting the photos in relation to
marketing or promotion of the property being sold or leased. These usage rights are
only active for the duration of the agents listing.
Commercial Clients: Builders, Architects, Designers etc.
Are entering into an “Unlimited Usage Agreement” with Banyan Photography. The
unlimited usage rights include printing or displaying images for commercial use through
website, print, and media advertising with no time limit.
The “Unlimited Use Agreement “ images are priced differently to “Limited Usage
Agreement” images.
For all clients photos may not be sold, leased or otherwise transferred to any
other person (including to other owners or agents).
Realtor and Leasing clients are able to purchase “Unlimited Usage Agreement” rights as
needed. Please contact banyan Photography for pricing and details.
Cancellation Policy
Appointments cancelled less than 24 hours prior to scheduled date and time will be
charged a $50.00 cancellation fee.
Privacy Policy

and safe online experience. Sometimes we do need information to provide services that

Local Taxes
Please note that local charges (sales tax, customs duty) may occur, and these charges
are at the customers own expense.Additional Information Banyan Photography reserves
the right to amend any information, including but not limited to prices, technical
specifications, terms of purchase and product offerings without prior notice. Banyan
Photography has the right to cancel the order and refund any amount paid by the
customer. Banyan Photography shall also notify the customer of equivalent replacement

Return Policy
Banyan Photography does not provide refunds after the service has been rendered.
